Terms and Conditions


General

In these conditions references to “the Company” are to Denmans Electrical Wholesalers Limited and references to the “Purchaser’ are to any person, firm or company with whom the Company enters into any contract, whether directly or indirectly. “Goods” shall mean the goods which are the subject of the contract.

Privacy

We respect your privacy and will not pass on your details to any third parties. Please contact us if you have any concerns.


Prices

The price payable for the goods is as set out on the website at the time you place your order, except in exceptional circumstances such as a failure of the system (all prices set to zero, all prices set to £999 or some other unusual detail/s). If you believe you have come across such as case, do not place an order, but contact us for advice. We reserve the right not to accept orders placed in such circumstances.   All prices exclude VAT that is chargeable at the standard rate of 17.5% (subject to changes in taxation) where applicable 


Payment

Goods are offered to you on a payment with order basis.

Your payment will be authorised by Barclays merchant services prior to dispatch or your order will be declined. We accept most major credit & debit cards subject to those acceptable by Barclays merchant services. At time of writing, thse are Visa, Visa Electron,  Mastercard, Switch, Solo, JCB and Maestro. No other form of payment is acceptable for internet generated orders.

 


Delivery

We deliver to Mainland U.K. only.

Orders can only be dispatched to the cardholders address; a signature will be required on delivery. We aim to pick and dispatch your order the same working day if received before 2pm. Orders are dispatched on a carrier service please normally allow 2-3 working days from the date of your order for delivery. On occasion it may take longer than this if we are out of stock or if you are out of the usual delivery range i.e remote locations within the UK, we will endevour to contact you by email if an unusual delay occurs. Please note that we make no deliveries over the Christmas period.

A carriage charge of £5 ex VAT will be applied to all orders below £50 ex VAT. Orders of £50 or over ex VAT will be delivered carriage-free.

 


Title

Title of the goods shall pass to you upon dispatch.

 


Availability

We aim to have all goods offered for sale on our website available ex-stock, in the event that we are out of stock we will dispatch the balance of the goods as soon as they become available.

 


Cancellation / returns

You may within up to 7 working days after you receive your goods cancel your order and return the goods for refund without stating a reason provided that the goods are in their original packaging and in the condition they were received in. Carriage is non-refundable and you must arrange your own carriage and insurance for the return.

To return goods believed to be faulty or mis-described, please email info@allaboutelectrics.co.uk with a full description of the problem.We will contact you to resolve the problem and arrange return.

Transport of goods back to allaboutelectrics will be paid by the Customer unless the goods are faulty or misdescribed, in which case allaboutelectrics will either arrange to collect the goods or ask you to return the goods and refund any agreed transport costs.

No other method of return is acceptable without prior agreement in writing from allaboutelectrics, and we will not pay any costs arising out of return of goods that has not been agreed.



Warranty and Exclusion

The Company will use its reasonable endeavors to assign the benefit of any warranty it receives from its supplier to the Purchaser.


The Company shall not be liable for any business interruption, loss of production, loss of profits, contracts, goodwill or anticipated savings, losses arising from any third party claims or any special, indirect or consequential loss (whether or not foreseeable) in respect of non-delivery, delay in delivery or of defects in the nature of or the quality of any Goods supplied by the Company nor shall the Company indemnity the Purchaser against any such claims except as is required by law and may not be excluded,


Nothing in these conditions shall exclude or limit the liability of the Company for death or personal injury resulting from its negligence insofar as the same is prohibited by United Kingdom statute.


Save as expressly provided in these conditions all terms, conditions, representations and warranties, (whether expressed or implied) relating to the sale of goods are excluded to the tallest extent permitted by law. The Goods are not sold by description or sample.


Subject to any of the limitations or exclusions of liability in these conditions, the maximum aggregate liability of the Company, its employees and agents, for breach of any contract and otherwise in connection with that contract) including for any breach of any statutory duty and any tortuous act or omission, (including negligence) shall so far as permitted by law be limited to the amount payable under the terms of the contract.


 


Descriptive Matter and Illustrations


All descriptive and forwarding specifications, drawings and particulars of weights and dimensions issued by the Company are approximate only and are intended only to present a general idea of the Goods described therein and nothing contained in any of them shall form part of any contract with the Company.

The Company reserves the right to vary the technique, design, construction and specification of Goods without notice.

 


Copyright

The Company reserves all intellectual property rights in the Goods and any tools used to produce them, including but not limited to copyright, registered and unregistered trademarks and confidential know-how. The Purchaser may not use any such rights without the Company’s written consent.

 


Force Majeure


The Company shall not be liable for any failure or delay in the performance of its obligations where the same is due to any circumstances outside its reasonable control including (without limiting the foregoing) war, strikes, lock-outs, industrial action, shortage of supplies, breakdown, transport delays, accidents, government action, tire, terrorism or criminal acts

 


Governing Law and Jurisdiction


Any contract between the Company and the Purchaser shall be governed and construed in accordance with English law. The Purchaser submits to the exclusive jurisdiction of the English Courts but the Company may enforce any each contract in any court of competent jurisdiction.
